Overview
Pursuant to the authority granted to the Maryland Aviation Administration (MAA) under Code of Maryland Regulations (COMAR) Title 11, Department of Transportation, subtitle 11.03.01.05 and consistent with industry practice and applicable Federal Aviation Administration (FAA) policy governing the self-sustaining operation of public use airports, this correspondence serves as formal notice of a financial change to the ground transportation operations at Baltimore/Washington International Thurgood Marshall Airport (BWI Marshall or Airport).
The MAA currently authorizes certain commercial ground transportation services at BWI Marshall through a permit-based process. After reviewing regulatory requirements, operational considerations, and industry best practices, the MAA has determined a change to the existing permit framework is necessary. Accordingly, the MAA is transitioning to a permit-contractual authorization model, under which all commercial ground transportation operators providing services to the public at BWI Marshall will be required, as a condition to receiving a permit, to enter into a contract with the MAA that will assess and include per trip fees. These fees are published in the BWI Marshall Tenant Directive 401.1, and as of 2026 the fee is $3.50 per trip.
This change is undertaken to ensure:
- Compliance with COMAR requirements governing the use of State-owned airport property and commercial activities thereon;
- Alignment with FAA obligations, including the requirement that the Airport be operated in a self-sustaining manner to the extent possible;
- Establishment of an enforceable standard for operational, safety, security, financial, and compliance requirements applicable to all ground transportation providers;
- A financial framework to address roadway congestion and repairs; and
- Fair and reasonable rates for all commercial operators dropping off or picking up passengers at the Airport Terminal.
The MAA hereby notifies you that following June 30, 2026, in order to continue providing ground transportation services, your company, along with all other current and prospective operators, must execute a valid concessions contract with the MAA. The company will also be required to self-report trips and remit revenues to the MAA on a monthly basis.
Any operator that fails to enter into a contract agreement with the MAA will be prohibited from continuing to conduct ground transportation services at the Airport. Operators attempting to conduct commercial ground transportation activities without the benefit of a duly authorized and executed contract shall be subject to enforcement action, including but not limited to fines, penalties, revocation of access privileges, and other remedies available to the MAA under applicable law and regulation.
